My work permit (EAD) after a K-1 visa: filed with the green card, card in hand in six weeks

· 4 min read

After you arrive on a K-1 visa and get married, you cannot just start working whenever you like. You need a work permit, the Employment Authorization Document (EAD). You ask for it with Form I-765.

I expected this to take months. It took six weeks from the post office to my mailbox. These are my real dates.

My timeline

  • July 3, 2026: I arrived in the US on a K-1 visa
  • September 1: I mailed my green card package (I-485) with the work permit form (I-765) inside
  • September 4: USCIS received the package. This is my official filing date
  • September 9: The receipt notices were issued
  • October 1: Biometrics appointment in Memphis: fingerprints and a photo
  • October 3: Work permit approved (4 weeks after filing)
  • October 6: The card was produced
  • October 8: The card was mailed
  • October 14: The card arrived (3.5 months after arriving in the US)

Filing it with the green card

I did not send the I-765 alone. I put it in the same envelope as my I-485 (the green card application), together with the I-131 (travel permit) and the I-864EZ (financial support form). I prepared that whole package myself, without a lawyer: Filing my green card application without a lawyer.

When you file them together:

  • The I-765 fee was $260.
  • The I-485 fee was $1,440.
  • The I-131 fee was $630.

Fees change. Always check the current fee on the official USCIS website before you mail anything.

The receipt notices

USCIS received the package on September 4, and the receipt notices are dated September 9. Each form gets its own receipt notice (Form I-797C), with its own receipt number. So I had a separate number for the I-765, the I-485 and the I-131.

Those receipt numbers are how you track each case online. Save them in one place. I also learned later that the I-485 receipt notice is a useful document by itself: offices use it as proof that your green card case is pending.

Biometrics

A few weeks later, the biometrics appointment letter arrived. Mine was on October 1, 2026, at the USCIS office in Memphis, a drive from where I live in Arkansas.

Biometrics is short: they take your fingerprints and a photo. Bring the appointment letter and a photo ID. If you miss it without rescheduling, USCIS can treat your application as abandoned. So do not miss it. Mine took less than ten minutes: My USCIS biometrics appointment.

Approved two days later

Two days after biometrics, on October 3, the status changed to approved. This is the approval notice USCIS mailed me:

My real I-765 approval notice: approved October 3, 2026, class C09, valid from October 1, 2026 to March 30, 2028. I covered the receipt number, my account number, my alien number and my address.
My real I-765 approval notice: approved October 3, 2026, class C09, valid from October 1, 2026 to March 30, 2028. I covered the receipt number, my account number, my alien number and my address.

The class C09 means the work permit is based on a pending green card application. Mine is valid for about a year and a half. The card was produced on October 6, mailed on October 8, and it arrived on October 14.

The approval came only four weeks after filing. That is fast. Many people wait several months, and processing times change a lot between offices and periods. So please do not plan your life around my timeline. Check the current processing time on the USCIS website.

What the card did and did not do for me

With the EAD, I can legally work in the US. That is the main point, and it changes everything.

But one surprise: when I opened my business bank account, the bank manager did not accept my EAD as photo ID. It is a US government photo ID, but that branch only wanted a driver's license or a state ID. I wrote about it here: Opening a business bank account as an immigrant.

So the EAD is your work permit. It is not always accepted as your everyday ID. Get a state driver's license or ID too.

Tips

  1. File the I-765 together with the I-485 if you are filing for a green card. One envelope, one biometrics appointment.
  2. Save every receipt number the day the notices arrive.
  3. Do not miss biometrics. Put it in your calendar the day the letter comes.
  4. Track the card in the mail. When it is mailed, USCIS shows a tracking number.
  5. Check fees and processing times on the official USCIS website, not on forums or old blog posts. Including this one.

Summary

  • I mailed the I-765 with my I-485 on September 1, 2026.
  • Receipt notices dated September 9, biometrics on October 1, approval on October 3.
  • The card arrived on October 14, six weeks after mailing.
  • The EAD lets you work, but some places still want a state ID.
